You are required to post a 300 word referenced response to one of the following discussion questions. Please respond to one from each of the flooring sections:
Section 1:
Do those accused of crimes have too many protections? Should victims of crimes have more rights? If so, what should some of those rights be? Discuss how the Fourth, Fifth, Sixth, and Eighth Amendments protect criminals, but no amendments protect victims. Point out how, in criminal cases, the victims aren’t even parties to the action; they are merely witnesses for the prosecution. Is this wrong? Should this system be changed?
How should we deal with the ambiguous nature of the Constitution when it comes to rights? In the case of the right to privacy, how much privacy do Americans have a right to? What other rights besides privacy might be ambiguous? Do students think this right to privacy exists and can be seen in the “penumbras” of the Bill of Rights?
Section 2:
What was the intent of the Equal Rights Amendment? Why did it fail? How, if at all, would the status of women be different today if the ERA were ratified? How do students feel about the argument that the ERA was not passed because enough federal legislation was passed to placate the groups fighting for its passage?
What are the similarities between the African American and women’s civil rights movements? What are the differences? In what ways have the movements helped one another? Are there any instances where one might have hindered the ability of the other to achieve its goals?
What is the current status of the gay rights movement? What victories have been gained? What still needs to be achieved? How likely is it that gays and lesbians will continue to obtain more rights in the future?
